Please read these Terms of Service carefully before using our website or visiting our store. By purchasing from us — online or in person — you agree to be bound by these terms. If you do not agree, please do not use our services.
1. About YoCamron's Aquatics
YoCamron's Aquatics is owned and operated by Cameron Navid Atherton, a marine biologist and aquarium professional based in New Milford, Connecticut. We sell live aquatic animals, plants, aquarium equipment, supplies, amphibians, and professional maintenance services both online and through our physical storefront.
2. Online Customer Terms
2.1 Account Registration
You may browse our website without an account. To place an order or access premium blog content, you may need to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must be at least 18 years old to create an account and make purchases.
2.2 Accuracy of Information
You agree to provide accurate, current, and complete information when placing orders. We reserve the right to cancel orders placed with inaccurate information.
2.3 Orders and Payment
All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order at our discretion, including if we suspect fraud or misuse. Prices are listed in U.S. dollars and are subject to change without notice. Payment is due in full at the time of purchase. We accept major credit cards and other payment methods as displayed at checkout.
2.4 Live Animal Orders
By purchasing live animals online, you acknowledge and agree that:
- You have a suitable, properly cycled aquarium or enclosure ready to receive the animal upon delivery
- You understand the basic care requirements for the species you are purchasing
- You accept responsibility for the animal's care once it has been delivered and acclimated
- You have read and agree to our Live Arrival Guarantee and DOA Policy (see our Shipping & Returns Policy)
- Live animals are perishable goods — all sales are final unless covered by our Live Arrival Guarantee
2.5 Premium Blog Subscription
Our premium blog subscription ($9.99/month) is billed monthly. You may cancel at any time; cancellation takes effect at the end of the current billing period. We do not offer refunds for partial months. Access to premium content will continue until the end of your paid period.
2.6 Intellectual Property
All content on our website — including text, photos, graphics, and blog articles — is the property of YoCamron's Aquatics and Cameron Navid Atherton. You may not reproduce, distribute, or commercially exploit any content without our written permission.
2.7 Prohibited Uses
You agree not to:
- Use our website for any unlawful purpose
- Attempt to gain unauthorized access to our systems or other users' accounts
- Transmit spam, viruses, or malicious code
- Scrape or harvest our content or customer data
- Resell live animals purchased from us for commercial purposes without prior written agreement
2.8 Disclaimer of Warranties
Except for the limited Live Arrival Guarantee expressly stated in our policies, all products and live animals are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that any animal will survive, breed, adapt to your system, or be compatible with your existing livestock beyond the express guarantee stated, or that our website will be uninterrupted, error-free, or free of viruses. Product descriptions are as accurate as possible, but we do not warrant that they are complete or error-free.
2.9 Limitation of Liability
To the fullest extent permitted by Connecticut law, YoCamron's Aquatics' total liability for any claim arising out of or relating to any product or order shall not exceed the amount you actually paid for the specific item giving rise to the claim. In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation the loss or death of other livestock, damage to or loss of aquariums, tanks, equipment, or established ecosystems, loss of profits, or the cost of substitute goods, even if advised of the possibility of such damages. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.
Order Cancellations & Refunds
We reserve the right to cancel any order, in whole or in part, at any time and for any reason. Reasons may include pricing or listing errors, suspected fraud, livestock availability, or an order shipping to a state or locality where the species purchased is illegal to keep, own, or import — for example, axolotls in Maine, and other species restricted by certain states. It is the customer's responsibility to know and follow the laws of their state and locality for any species they order; if we identify a species that is restricted for your delivery location, we will cancel that item rather than ship it.
When we cancel an order or item, you receive a 100% refund of the amount paid for the canceled item(s) to your original form of payment. This store-initiated cancellation right is separate from our Live Arrival Guarantee (which governs animals that arrive deceased or distressed) — a cancellation is always refunded in full to your original payment method. If you cancel an order at your own request, it is refunded as store credit, less a 5% restocking fee, rather than to your original payment method.
2.10 Assumption of Risk — Live Organisms
By purchasing live animals or plants, you acknowledge that you are buying living organisms whose health after delivery depends on factors within your sole control — acclimation, water quality, temperature, feeding, tankmate compatibility, and existing tank conditions. You accept the inherent risks of purchasing, transporting, and keeping live organisms, and agree that YoCamron's Aquatics is not responsible for losses resulting from acclimation, husbandry, compatibility, or conditions in your system after delivery.
2.11 Buyer Responsible for Local Legality
You are solely responsible for confirming that any animal or plant you purchase is legal to own, import, and possess in your state and locality. By ordering, you represent that it is legal at your delivery address. We may refuse or cancel any order we believe would ship a restricted species into a jurisdiction where it is prohibited, and we are not liable for confiscation, fines, or losses resulting from your purchase of a restricted species. You agree never to release any purchased animal or plant into the wild or into any natural waterway.
2.12 Indemnification
You agree to indemnify, defend, and hold harmless YoCamron's Aquatics, its owner, and its employees from any claim, liability, loss, fine, or expense (including reasonable attorneys' fees) arising out of your care, housing, resale, release, or handling of any product or animal purchased, your violation of these Terms, or your violation of any law or the rights of any third party.
2.13 Binding Arbitration & Class-Action Waiver
PLEASE READ — THIS AFFECTS YOUR LEGAL RIGHTS. Any dispute arising out of or relating to these Terms or any purchase shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court. You and YoCamron's Aquatics agree that each may bring claims only in an individual capacity, and not as a plaintiff or class member in any class or representative proceeding. This agreement to arbitrate is mutual. You may opt out by sending written notice to cameron@yocamronsaquatics.com within 30 days of your first purchase.
2.14 Severability, Entire Agreement & No Waiver
If any provision of these Terms is held unenforceable, it shall be limited or severed to the minimum extent necessary and the remaining provisions remain in full force. These Terms, together with our Privacy Policy and posted policies, are the entire agreement between you and YoCamron's Aquatics and supersede all prior communications. Our failure to enforce any provision is not a waiver of our right to enforce it later.
2.15 Point of Sale; Adoption of Restricted Species
All retail sales by YoCamron's Aquatics are made and completed in the State of Connecticut at our New Milford location, even where goods are subsequently shipped to customers elsewhere. Regardless of where an order is delivered, customers remain solely responsible for compliance with the laws of their own state and locality (see Section 2.11).
Certain species cannot lawfully be sold at retail in Connecticut. We do not offer those species for retail sale. Where an animal in this category is made available, it is transferred only through an adoption and rehoming arrangement for an adoption fee — not as a retail sale — and only where such transfer is permitted by applicable law. We reserve the right to decline any adoption or transfer at our discretion.
3. In-Store Customer Terms
3.1 Store Entry
By entering our store at 16 Bridge Street, New Milford, CT 06776, you agree to conduct yourself in a respectful manner toward our staff and other customers. We reserve the right to refuse service or ask any person to leave the premises for disruptive, threatening, or inappropriate behavior.
3.2 In-Store Purchases
All in-store sales are final unless otherwise noted or covered under our In-Store Live Guarantee (see our Shipping & Returns Policy). We accept cash, credit cards, and debit cards. Sales tax will be applied as required by Connecticut law.
3.3 Live Animal In-Store Sales
By purchasing a live animal in our store, you acknowledge that:
- You have a properly set up and cycled aquarium or enclosure ready at home
- You take full responsibility for the animal's care upon leaving the store
- You have been advised of the basic care requirements for your purchase
- You agree to our In-Store Live Guarantee terms (see Shipping & Returns Policy)
3.4 Consultations and Advice
Advice provided by Cameron or our staff is based on professional experience and expertise but is offered as general guidance. Outcomes in aquariums and enclosures vary greatly depending on individual tank parameters, husbandry practices, and other factors beyond our control. We are not liable for livestock or equipment losses that result from following advice given in good faith.
3.5 Maintenance Services
Professional aquarium maintenance services are provided under a separate service agreement. By booking a service, you agree to provide safe access to your aquarium and acknowledge that YoCamron's Aquatics is not responsible for pre-existing conditions, equipment failures, or losses resulting from factors outside our control during a service visit.
4. Appointment Booking
Appointments booked via our Google Calendar scheduling tool are subject to availability. We ask for at least 24 hours notice for cancellations. Repeated no-shows may result in a requirement for a deposit to book future appointments.
5. Governing Law
These Terms of Service are governed by the laws of the State of Connecticut, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Litchfield County, Connecticut.
6. Changes to These Terms
We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated date. Continued use of our website or store after changes are posted constitutes acceptance of the new terms.
