Terms of Sale — YoCamron's Aquatics

By placing an order you agree to these terms and to the full Terms of Service, Shipping & Live Animal Policy, and Refund Policy published on our website, which are incorporated here by reference.

Point of sale. All sales are made and completed in the State of Connecticut and are governed by Connecticut law, without regard to conflict-of-laws rules. Shipping is offered nationwide as a convenience and does not change where the sale occurs.

Disclaimer of warranties. Except for the Live Arrival Guarantee and In-Store Live Guarantee expressly stated in our policies, all livestock and merchandise are sold "as is." We disclaim all other warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that any animal will thrive in your system, remain free of disease, breed, retain coloration, reach any particular size, or be compatible with your existing livestock.

Limitation of liability. To the maximum extent permitted by law, our total liability for any claim arising out of or relating to your order is limited to the amount you actually paid for the item giving rise to the claim. We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of other livestock, tank crashes, disease introduced into an existing system, damage to aquariums, equipment, flooring, or property, lost profits, or loss of use — even if we were advised of the possibility of such damages.

Assumption of risk. Keeping live aquatic animals carries inherent risk. Animals are living organisms and may die from causes outside anyone's control, including stress, latent disease, water chemistry, or acclimation. You accept these risks when you purchase.

Buyer responsibility for local legality. You are solely responsible for verifying that any species you purchase is legal to possess, transport, and keep at your address, and for holding any permit or license your state or municipality requires. You agree not to release any purchased animal or plant into any natural or public waterway, storm drain, or wild environment under any circumstances. You are responsible for any fine, seizure, or penalty resulting from a purchase that is unlawful where you live.

Indemnification. You agree to indemnify, defend, and hold harmless YoCamron's Aquatics, its owner, employees, and agents from any claim, loss, liability, fine, penalty, or expense (including reasonable attorneys' fees) arising from your purchase, possession, transport, care, resale, or release of any animal or plant purchased from us, or from your violation of these terms or of any law.

Binding arbitration and class-action waiver. Any dispute arising out of or relating to your purchase that cannot be resolved informally shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in or conducted remotely from Connecticut. You and we each waive any right to a jury trial and to participate in a class, collective, or representative action. Either party may bring an individual claim in Connecticut small claims court instead. You may opt out of this arbitration provision by emailing cameron@yocamronsaquatics.com within 30 days of your first order.

Restricted species and adoption. We do not ship species prohibited at the delivery address, and orders containing them will be cancelled and refunded in full. Certain species whose sale is prohibited in Connecticut are not offered for sale; where we place such an animal, it is transferred by adoption for an adoption fee, and the adopter assumes full legal responsibility for lawful possession.

Pricing and availability. Prices, availability, and listings are subject to change without notice. We may correct errors and cancel affected orders with a full refund. Photographs are representative; individual animals vary in size, color, and pattern.

Age. You must be 18 or older, or have the consent of a parent or legal guardian, to place an order.

Severability, entire agreement, no waiver. If any provision is found unenforceable, the remaining provisions stay in force. These terms, together with our published policies, are the entire agreement between us. Our failure to enforce any provision is not a waiver of it.
